PETALING JAYA (Jan 30): The National House Buyers’ Association (HBA) has come up with a suggestion to fix the overhang problem of residential properties in the affordable pricing range: rent them out.

Arriving at the National House Buyers’ Association office at Kuala Lumpur’s Jalan Imbi, its honorary-secretary general Datuk Chang Kim Loong greets us with a smile and leads us to HBA’s small but cosy office where the organisation has for the past 18 years, attended to thousands of homebuyers’ grievances.

PETALING JAYA (Nov 2): The National House Buyers Association (HBA) has urged the government to take measures to slow down escalating property prices by raising the supply of homes in the affordable housing segment through  government-linked corporations, state economic agencies and  bodies such as Perbadanan PR1MA Malaysia (PR1MA).

The first question a homebuyer should ask is probably “who’s the developer?” The biggest nightmare for a property buyer is when a project fails to be delivered or when it is delayed for a prolonged length of time.

  分层地契与遗嘱一样，通常是在你脱售产业时才会发现它的重要，因为没有分层地契，原本简单的产业转手手续，或许就会变成一条漫漫长路。 简单来说，分层地契就是你的产权证明文件，也是一份可让你控制分层产业单位的文件。 除了是持有权证明，大马购屋者协会（HBA）荣誉总秘书长Chang Kim Loong指出，分层地契也在产业交易中，不可或缺的重要工具。 他说：“业主若未取得分层地契，该土地和项目的共用空间和资产，依然属于发展商名下。在还获得分层地契前，发展项目一旦不幸被搁置，发展商若宣布破产，那业主必须自行面对许多问题，例如与发展商债主谈判。一些业主甚至必须自掏腰包，付钱赎回自己单位的分层地契。” Chang补充，如果购买没有分层地契的二手分层房屋，一些金融机构不太愿意发放贷款。假设买卖双方坚持交易，那Chang则劝告双方，应咨询律师以保障自己的权益。 不过，新落成项目的买家或不用再面对上述分层地契的问题，因为政府已更新了2013年分层地契法令，要求发展商在空屋移交（Vacant Possession）给买家时，必须一并移交分层地契。 有鉴于此，目前大部分向发展商争取单位分层地契的业主，都是在上述法令于2015年6月生效前，购买房屋的屋主。 虽然已有分层地契转交法令，但Chang表示却缺乏执行能力，举例说，在买卖合约的第12条内都有指出，发展商有义务承担分层地契的申请成本，但在现实中，遵守该条文的发展商并不常见。 Chang说：“我们常常听见发展商因没有负责申请分层地契而被控上法庭，但多少发展商因为没有遵从上述条文而被告？” 他说，其中原因或因是发展商不重视分层地契的重要性，其二是因为当局缺乏执行能力，再来是买家懦弱怕事，若买家不告发发展商，则不会有人知道该项目已经获得了分层地契与否。 分层地契或否影响房价？ Marcus Hwang & Co律师事务所的Marcus Hwang指出，产业的价值不会因为没有地契或分层地契而打折扣。 “没有任何一条条文指，拥有分层地契与否会影响单位持有人的权益。一些银行发出给没有地契的产业的贷款，与发给有地契产业的贷款是一样的。同时，也没有指引说分层地契可以提高贷款的数额。“ 他补充，有否地契的唯一分别，在于拥有权转移的文件上，如果有分层地契，该文件则会被成为地契转让文件（Memorandum of Transfer），该文件是必须向土地局登记的。 至于没有分层地契的话，文件模式则是转让。也就是说，在支付契约的全额印花税后，所有买卖合约合约下的权益将归新买家，这是属于技术上承认新买家为该单位的合法持有人。 无论如何，他坦诚一些数十年尚未获得分层地契的房子，而当年的发展商也已不存在市场上的话，银行则会在发放全额申请贷款时，再三考量。 如果你还没有得到分层地契，那该怎么办？ Ampang Jaya建筑物委员会（COB）主任Muhammad Noor Isman Ismail分享，如果发展商已经清盘，则必须委任负责人，继续向土地局申请分层地契，该动作的额外费用由分层地契业主承担。 原文已刊登于2018年6月8日的EdgeProp.
