PUTRAJAYA (Oct 27): Pekan Umno Youth division chief Datuk Mohamad Nizar Mohamad Najib is appealing against the Shah Alam High Court’s decision on Aug 7 to enter a summary judgement over his purported unpaid taxes amounting to RM13.16 million.

Nizar is the son of former prime minister Datuk Seri Najib Razak.

The decision was made by Judicial Commissioner Datuk Julie Lack, and Nizar's counsel had filed a notice of appeal dated Aug 11 over the decision.

A summary judgment is a judgment that is entered by court based on written submissions alone, minus a full trial and witness testimonies. The court may be satisfied that there are no triable issues to be decided.

Nizar, 42, is the second of Najib's children to have a summary judgment entered against them.

On July 6, the Kuala Lumpur High Court's Justice Datuk Ahmad Zaidi Ibrahim entered a summary judgment against Datuk Mohamad Nazifuddin Najib for allegedly owing taxes amounting to RM37.6 million between 2011 and 2017.

Besides this, the Inland Revenue Board (IRB) had also obtained a summary judgment against Najib — who is said to owe RM1.69 billion in taxes — which he is appealing.

Meanwhile, the board is appealing against the Shah Alam High Court’s decision after the latter dismissed the former’s application for a summary judgement against the former premier’s daughter Nooryana Najwa Najib.

Today is the first case management to Nizar's case before Court of Appeal deputy registrar Noridah Adam, who fixed Dec 16 for further case management in order to keep the court updated on the filing of the records of appeal.

Today's case management was confirmed by Nizar's counsel Muhammad Farhan Shafee.

The Malaysian government, which is the plaintiff in this case, filed the writ of summons and originating summons on July 24, 2019, claiming Nizar owed additional taxes imposed from 2011 to 2017.

In March, the board claimed that Nizar owed the following amounts:

RM856,505.92 (2011)

RM1.62 million (2012)

RM1.59 million (2013)

RM530,066.52 (2014)

RM1.22 million (2015)

RM1.91 million (2016)

RM3.76 million (2017)

As he did not pay up within 60 days, the IRB imposed on him a further 5%, bringing the total tax due to RM13.159 million.

The government is also seeking 5% interest on the total, from the date of judgment to the date of settlement, as well as costs and any other relief deemed fit by the court.
