This relates to the condos in Pavilion Residences which are also subject to forfeiture by the Malaysian government, as they had been used to house the items acquired from proceeds allegedly obtained using 1Malaysia Development Bhd (1MDB) funds.
The order was made by Justice Datuk Muhammad Jamil Hussin after hearing the submission by Rosmah's lawyer, Iskandar Shah Ibrahim, and objection by Deputy Public Prosecutor Fatnin Yusof.
Quizzed by ad-hoc prosecutor Datuk V Sithambaram, the witness (Tan Sri Dzulkifli Ahmad) said he only knew further statements were recorded by the commission from media reports quoting his successor Datuk Seri Mohd Shukri Abdull.
Dzulkifli, 52, who later replaced Abu Kassim as MACC chief commissioner in 2016, said it was not proper for his predecessor to recommend charging the former premier as various statements from vital witnesses had not been recorded.
“In a letter by Jepak Holdings to the ministry on Sept 1, 2016, it said it was prepared to meet to discuss over the project. However, I found that Jepak did not submit the detailed proposal, its finance and technical plan, to the ministry.”
The four include former premier Datuk Seri Najib Abdul Razak's 1Malaysia Development Bhd (1MDB) trial, Najib and former 1MDB president Arul Kanda Kandasamy's joint 1MDB audit tampering case, and Najib's wife Datin Seri Rosmah Mansor's graft trial.
