KUALA LUMPUR (Aug 28): Bina Darulaman Bhd (KL:BDB), Kedah state government’s investment holding company, said it is facing a lawsuit over alleged trespassing of stray golf balls into a private property in the state.

The group said the suit was filed by an individual named Mohd Nazli Ahmad Mahyadin against BDB and its subsidiaries, BDB Darulaman Golf Resort Bhd and BDB Land Sdn Bhd.

He is seeking general damages of RM1 million and special damages for alleged deprivation of use and enjoyment of his property in Bandar Darulaman, Jitra due to the entry of stray golf balls into the property.

Mohd Nazli is also claiming for exemplary damages of RM3 million and aggravated damages of RM3 million from BDB and its subsidiaries, according to the group's bourse filing on Wednesday. 

"The directors have instructed its solicitors to take all appropriate legal actions to defend the interests, good standing and innocence of BDB and its subsidiaries," BDB said.

During case management on Aug 4, both parties agreed to proceed with mediation for the case. The case is now scheduled for mediation on Sept 26.

According to BDB, Mohd Nazli had previously served a notice of demand in 2020, seeking a long-term solution by building a safety net with reasonable measurements.

The group said it had responded by elevating the safety net near Mohd Nazli’s property to a height of 28 feet and width of 80 feet as a precaution to prevent the golf balls from entering the property.

BDB shares closed up one sen or 3.08% at 33.5 sen on Wednesday, giving the group a market capitalisation of RM100.25 million.
